Terms & Conditions

  1. Instructions on how to enter form part of these terms and conditions. By entering this promotion, you agree to be bound by these terms and conditions and failure to adhere to them shall result in disqualification.
  2. The promoter is Cadbury Ireland Limited, Coolock, Dublin 5 (the “Promoter”).
  3. This promotion is open to residents of the Republic of Ireland aged 18 years or over, except employees or agents of any company associated with this promotion (at any time during the term of this promotion) and their families.
  4. Entry to this promotion opens on 03.11.09 at 7.00am and ends on 18.12.09 at midnight
  5. Entries will only be accepted if they are submitted in the appropriate manner and on the official paper or digital design template which is available in participating stores nationwide, from promotion staff at promotional events or from the website (www.cadbury.ie/theapprentice).
  6. For the chance to win, entrants must submit their entry prior to the Closing Date, through any of the following means:
    1. Posting their design into ‘Cadbury Apprentice Promotion’, 6 Ely Place, Dublin
    2. By handing their entry to promotion staff at promotional events due to take place at the following times and places: [National College of Art & Design 04.11.09, University of College Dublin 05.11.09, University of Cork 10.11.09, School of Art & Design Limerick 11.11.09 and National University of Ireland, Maynooth 12.11.09] (the Promoter accepts no responsibility for loss of entries submitted in this, or any other manner);
    3. By logging onto the website (www.cadbury.ie/theapprentice) and following the instructions. Design tools and applications will be available online to facilitate entry; or
    4. By scanning their design and emailing it to theapprentice@cadbury.com
  7. Multiple entries permitted per individual.
  8. Entrants must ensure that: (a) The entry is the entrant’s original creation and has not been copied, adapted or amended from any other work (save for any existing packaging design of Cadbury Dairy Milk); (b) does not contain any material which: (i) is offensive and/or derogatory; (ii) is of a explicit and/or sexual nature; (iii) is defamatory, libellous, obscene; or (iv) is otherwise illegal; (c) does not contain any material which violates any third party intellectual property rights (including, but not limited to, copyright, trade marks, or any other proprietary or personal right); (d) does not contain any trade/brand logos or references other than incidental inclusion and/or relating to the Promoter’s products; (e) does not encourage excessive consumption of confectionery, is not purposefully designed to market confectionery directly to children, nor encourage unsupervised consumption of confectionery by children under 8 years old; and (f) complies with the provisions of the ASAI code, and in particular sections relating to children, and food and drink.
  9. Entrants must incorporate an Irish theme into their design.
  10. In consideration for entering into this promotion entrants agree to assign to the Promoter (or an associated company of the Promoter nominated by the Promoter) irrevocably and absolutely all right, title and interest in the copyright in the packaging design in the Republic of Ireland (and/or any other intellectual property rights subsisting in the entry) and throughout the world, for the full duration of such copyright including any extensions and renewals, including the right to sue for past infringement of such rights. Entrants hereby waive all moral rights to the extent permissible in law, and agree that the Promoter and its associated companies shall be free to alter, modify, adapt, or amend the packaging design as it sees fit in its absolute discretion. Entrants agree to enter into such further documentation as is required by the Promoter to give full effect to this clause.
  11. Five finalists will be chosen by a panel of independent judges and announced on the website by 11.01.10. Finalists will be notified individually by telephone. The judges’ decision will be based on the design that, in the judges’ opinion, best captures the Cadbury Dairy Milk Irish theme. Once the five finalists have been chosen, an advertising campaign will be developed, by the Promoter and/or its agents, to run online and in mainstream media. Irish residents over 18 years old will be able to vote for their favourite design from the five finalist entries through the website (www.cadbury.ie/theapprentice) or by mobile (by texting VOTE and their choice A – E to 53799.   12. The final winner is chosen by public vote through the website. Only one vote per email address and mobile number per day is permitted.
  13. All voting entries (via website and mobile) will be entered into a weekly random draw. Each entry will have a chance of winning a Cadbury hamper, this being the prize for the draw taking place in the week in which the vote was placed. There are five draws and five hampers in total available to be won. Weeks are counted as Monday to Sunday. Winners will be contacted via email or phone and the hamper will be delivered within 28 days, provided that the winner responds to contact made within 3 months of contact informing them of the win.
  14. Voting commences at 9am on 11.01.10 and closes at midday on 12.02.10. The winner will be announced on 15.02.10.
  15. There is one prize to be won, consisting of €10,000 to be paid by cheque, and, in addition to which, the winner’s packaging design and name will be featured on a wrap/package for Cadbury Dairy Milk that will subsequently be launched in 2010 in the Republic of Ireland.
  16. The winner shall be informed by telephone and will receive the Prize by post.
  17. The finalists and ultimate winner must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of the Prize, free of charge, and they consent to the Promoter using their names and images in promotional material.
  18. At all stages of this promotion the judges’ decision is final and no correspondence will be entered into with regard to this promotion.
  19. The Prizes are not transferable or exchangeable and cannot be redeemed for any other form of compensation. In the event for any reason the Prize winner does not take an element of the Prize, then that element of the Prize will be forfeited by the winner. If for any reason a Prize is not available or becomes impossible or illegal for the Promoter to award or deliver, the Promoter reserves the right to substitute another Prize for it, in its sole discretion, of equal or higher value.
  20. If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the promotion, or invalidate any affected entries. The Promoter reserves the right to amend or withdraw this promotion at any time. Please check the Promoters website for a current version of the terms and conditions applicable to this promotion. The Promoter may, at its sole discretion, disqualify all or any entries from, and prohibit further participation in this promotion by, any person who tampers with or benefits from any tampering with the entry process or manipulates the voting process in a manner that amounts to abuse of the system or fraud (or with the operation of this promotion) or who, in the sole opinion of the Promoter, acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
  21. The Promoter accepts no responsibility for late, incomplete, incorrectly submitted, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise.
  22. The Promoter does not warrant that any use of or access to its website will be uninterrupted by error or virus free, nor shall it have any liability for damage caused by hostile software which may infect a participant’s equipment or property as a result of that participant using or browsing the website.
  23. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the Prize, except for any liability which cannot be excluded by law (such as liability for death, personal injury, or fraud) in which case that liability is limited to the minimum allowable by law.
  24. The Promoter is the data controller. All entries will be the property of the Promoter. By entering this promotion entrants agree that certain pieces of their personal information provided will be used by the Promoter for the purpose of conducting this promotion. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this promotion or communicating with entrants. Any personal data relating to participants will be used solely in accordance with current Irish data protection legislation and subject to the terms of this clause will not be disclosed to a third party without the individual’s prior consent.   26. These terms and conditions shall be governed by Irish law and subject to the exclusive jurisdiction of the Irish courts.
  27. This promotion is operant pursuant to a Lottery Licence granted to the Make-A-Wish Foundation by the Dublin District Court, is subject to laws of the Republic of Ireland and the Irish courts.
